A take-away has been given permission to serve customers until 3am in a busy student area of West Leeds.
Foodie, on Burley Road, was granted a late-night licence after agreeing to measures to prevent noise and litter.
An objection was raised by Little Woodhouse Community Association, which called for shorter opening times after the application was made to Leeds City Council.
Muhammad Baig, who took over the business in May, said litter picking would be carried out and delivery drivers would be asked to keep quiet.
He told councillors: “If any litter is found within 100 metres of the store it will be my responsibility to pick it up.”
Mr Baig said other late-night food outlets had been allowed to operate nearby. He added: “I think it would be unfair if I was not granted permission to trade.”
Deryck Piper, representing the Little Woodhouse group, suggested closing times of midnight, Sunday-Thursday, and 1am at weekends.
He told the licensing hearing: “I have no objection to this gentleman opening a hot food takeaway at 70 Burley Road.
“What I’m concerned about is this being totally out of context with the area.”
The hearing was told an agreement was reached with West Yorkshire Police over conditions on the licence.
The premises previously had permission to serve until 3am up until February this year, when the company running it was dissolved.
The new licence, applied for by Baig and Brothers Ltd, was granted following the hearing at Leeds Civic Hall yesterday (Tuesday).
