Kirkstall: Burger King bids for 5am drive thru extension

By Don Mort, Local Democracy Reporting Service

A Burger King outlet in West Leeds could operate its drive-thru service until 5am, if an agreement is reached with the council.

The fast food chain has applied to extend the hours customers can order from their cars at its site at Savins Mill Way in Kirkstall.

Planning permission currently allows both the drive-thru and indoor restaurant to operate from 7am-midnight.

A late night refreshment licence has already been granted by Leeds City Council for orders between 11pm-5am.

But Burger King cannot extend its drive-thru hours without also securing a variation to the planning permission.

A planning report said: “This application seeks to update the planning permission to align the planning hours with those recently consented under the license.”

Burger King said the opening hours of the interior area, near retailers Matalan, Boots and B&M and Morrisons, would not be extended.

The report: “However, it is confirmed that the hours of use of the internal restaurant area will remain at those originally approved, 7am to midnight daily, and that the site will switch to being a drive-thru only from midnight until 5am.”

The company was given permission to build the drive-thru near busy Kirkstall Road in 2024. Councillors originally voted to reject the scheme after road safety concerns were raised.

But it was eventually allowed that October after planning officers said the traffic impact was not sufficient to refuse permission.

The planning report said conditions were placed on the premises licence to prevent anti-social behaviour, including CCTV and an incident log being kept.

It said: “Notices will also be displayed within the restaurant and premises to request that patrons respect the needs of local residents and leave the area quietly, which will be overseen by restaurant staff.

“Existing measures for the prevention of disturbance and litter will be extended into the widened trading hours.”

A planning application to vary the operating hours is out for consultation until October 21. The application can be found here.

  1. Why would anyone say there would be a traffic problem when both entrance and exit lead onto a CAR PARK.
    Sorry council clowns would.
Also suggests residents would be effected.
    There are no nearby residents.???
